Nothing on this site is legal, compliance, tax, or medical advice. Coding and billing decisions remain yours, and where a decision requires certified coding judgment it should get it. We say the same thing inside the product.
The text, design, and software on this site belong to NAKIRA Solutions. CPT, ICD-10, and other code sets referenced here are the property of their respective owners; we reference codes for identification and do not license them to you. CMS rule content is public.
We may change, pause, or remove parts of this site, including the demo. Where a capability is described as requiring a Business Associate Agreement or payer enrollment, that requirement is real and is not waived by anything on this site.
To the fullest extent permitted by law, this site and its content are provided “as is” and “as available.” NAKIRA Solutions disclaims all express and implied warranties concerning the site, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure, or complete, or that its content will always be accurate or current. Nothing in these terms affects warranties that cannot lawfully be excluded.
To the fullest extent permitted by law, NAKIRA Solutions and its members, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising from or related to your use of or inability to use this site. To the fullest extent permitted by law, their total aggregate liability arising from or related to the site will not exceed the greater of $100 or the amount you paid NAKIRA Solutions specifically for access to the site during the twelve months before the event giving rise to the claim. These limitations do not apply to liability that cannot lawfully be limited.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless NAKIRA Solutions and its members, officers, employees, contractors, and agents from third-party claims, damages, liabilities, judgments, costs, and reasonable attorneys' fees arising from content you submit through the site, your material violation of these terms, or your unlawful or unauthorized use of the site. This obligation does not apply to the extent a claim results from NAKIRA Solutions' negligence, willful misconduct, or violation of law. NAKIRA Solutions may control the defense of an indemnified claim, and you may not settle a claim in a manner that admits fault by or imposes an obligation on NAKIRA Solutions without its prior written consent.
Before filing a lawsuit concerning these terms or the site, you and NAKIRA Solutions agree to provide written notice of the dispute and attempt in good faith to resolve it for at least thirty days. Notice to NAKIRA Solutions must be sent to info@nakirasolutions.com. If the dispute is not resolved, these terms and any dispute arising from or related to them or the site will be governed by Delaware law, without regard to conflict-of-law principles. The state and federal courts located in Delaware will have exclusive jurisdiction and venue, and each party consents to their jurisdiction. This section does not prevent either party from seeking temporary or emergency injunctive relief where appropriate.
